The raised public profile of sexual harassment in the workplace and recent developments in the law have meant that employers who adopt a reactive approach to sexual harassment in their workplace are unlikely to meet compliance requirements. Sexual harassment has become a risk management issue that employers would be ill-advised to ignore.

 

This programme outlines a risk management approach to sexual harassment in the workplace. The programme develops participants' understanding of the circumstances in which employers and individuals can be held liable for sexual harassment in the workplace. It identifies the "reasonable steps" defence, that is, the steps an employer should take to prevent sexual harassment in the workplace. The programme builds the skills of participants to manage complaints of sexual harassment, and to develop proactive strategies for building a workplace that has a zero tolerance of sexual harassment.

Learning Content

 

This half day programme will cover the following topics:

•    Recent changes in sexual harassment law in the area of employer obligations and the definition of sexual harassment

•    Identifying when an organisation and individuals may be liable for sexual harassment

•    Sexual harassment and social media

•    An explanation of the “reasonable steps” defence for employers

•    Employer’s compliance obligations regarding prevention

•    Best practice principles for managing sexual harassment complaints

 

 

Learning Outcomes

 

At the conclusion of this programme, participants will:

•    Understand the legal obligations on both employers and individuals regarding sexual harassment in the workplace

•    Be aware of the implications of the use of social media by employees

•    Have the skills to identify how employer’s compliance obligations can be implemented

•    Have the skills to identify risk factors that might contribute to sexual harassment in the workplace and measures to control those risks

•    Have practical skills to manage complaints of sexual harassment in the workplace
